Being acquainted with hunting, firearms, and silencers before writing an article about them seems like a good idea, right? The editorial board of Raleigh’s News Observer would beg to differ.

According to an unsigned editorial from the Sunday edition, when the state legislature lifted the state’s silencer hunting ban this past spring, it put the public at risk. The author apparently believes that hunters are out there steadily banging away with their unsuppressed firearms all the live long day. The writer opines that this practice must be the only thing keeping people from being gunned down while traipsing over hill and dale in the Tarheel state.

But Prince isn’t just a paper pusher—he likes to touch off a few rounds here and there, too. Occasionally, I talk to someone about the National Firearms Act registration process, with all of its hassles, and their response is “why not just skip the rigmarole?” The short answer, of course, is that staying legal, even when the laws you are obeying are stupid and unjust, has it benefits. As a firearms enthusiast, I don’t want to become a prohibited person and lose my legal right to possess firearms. I want to keep as much of my liberty as I can.

Since his initial arrest last October, a home silencer hobbyist in Weston, Wisconsin has learned this lesson the hard way. From the Wausau Daily Herald:

A Weston man who posted a Facebook video of himself using a homemade silencer on a rifle was ordered Wednesday to serve three years of federal probation and fined $1,000.

Jason M. Trempe was arrested by federal authorities after they were alerted to the video and found the silencer and legal firearms in his home during a search in October 2012.

Both Trempe’s attorney and Assistant U.S. Attorney Peter Jarosz agreed that Trempe, 30, didn’t build the silencer with evil motives in mind. Instead, Trempe was driven by an inherent curiosity about mechanical devices and a fascination with guns to make “a not very good” silencer for a rifle, Jarosz said.

I have been a firearms owner for several years but it was only recently that I became interested in National Firearms Act (“NFA”) weapons. Specifically, I wanted to learn more about suppressors.

Suppressors or “silencers” fall under the same set of laws that also regulate short-barreled rifles, short-barreled shotguns, machine guns, destructive devices, and the catch-all category known as “all other weapons.” To lawfully possess these items one must submit paperwork to the ATF and pay an excise tax. The process for individuals requires the signature of your chief local law enforcement official (usually the county sheriff), but you can also register the device to a trust, corporation, or other legal entity.

ATF deep-sixes eForms due to shutdown

The above takedown notice is now greeting folks who try to use the newly upgraded ATF eForms system. ATF is asserting that this is a result of the government shutdown. This is a particularly unfortunate development, because it appeared that the eForms system was greatly accelerating the NFA registration process, eliminating as much as two months from the nine to ten month ATF paper chase.

I’m not sure what the incremental cost of maintaining a very simple web interface like eForms might be for the federal government, but I suspect it is less than the pay earned by the federal employees dispatched to rough up elderly veterans in Washington, DC.

AAC rolls out “Stand Silent” promotion

In response to the new NFA regulatory proposal, AAC recently announced a promotion for October. AAC is trying to get more folks into a can before the market shrinks by virtue of the effective prohibition in markets with uncooperative law enforcement. Retail customers buying an AAC silencer or short rifle before October 25th are eligible for a $100 store credit.

WSJ: “Silencers Loophole Targeted for Closure”

Following the talking points used by the New York Times back in February, the Wall Street Journal published an article on Thursday characterizing the ATF’s proposed regulations as closing a “loophole” in the federal firearms law.

The Journal’s  Joe Palazzolo interviewed Silencer Shop’s Dave Matheny, who pointed out that the more restrictive regulations would amount to an effective prohibition in jurisdictions with uncooperative local law enforcement officials who refuse to sign NFA paperwork. “‘It’s going to absolutely destroy this market,’ said Mr. Matheny, who employs eight people at his shop. ‘If sheriffs won’t sign, they’ve essentially made them illegal.'”

ASA lobbyist talks about winning silencer strategy

In the silencer industry, this year has been a year of creeping bureaucracy, with nasty proposed regulations pending at ATF and ever-increasing paperwork processing times. But 2013 has otherwise been a good one for the silencer industry, which continues to grow. SilencerCo was even recognized by Inc. magazine as one of the “Top 500 Fasting Growing Companies in America.” On the public policy front, there were legislative wins in a number of states, especially for hunters interested in using silencers for hearing protection while hunting.

The American Silencer Association has played a major role in these state-level legislative victories. One of ASA’s lobbyists, NRA board member Todd Rathner, was interviewed for the September 2013 edition of Western Shooting Journal.

Bluffs Shooters event in October

NFA dealer Chad McCumbers out at The Gun Shop in Morrill, Nebraska has announced a two-day shooting event at Bluffs Shooters Range north of Scottsbluff on October 19th and 20th. The first day will feature a recreational machine gun shoot where folks can enjoy touching some rounds off with all different types of NFA firearms. There will also be an open pistol and subgun challenge. On day two, there will be a precision rifle match featuring targets at ranges of 25–300 yards. Chad promises a “fun and challenging course of fire.”
